1. Scope and contracting party

These General Terms and Conditions apply to all orders of goods placed in the online shop "Town Town" at town-town.store. They apply to consumers within the meaning of section 1 of the Austrian Consumer Protection Act (KSchG) and to business customers, unless otherwise stated below. In these terms, "you" refers to our customers.

Deviating terms and conditions of business customers only apply if we expressly agree to their inclusion.

2. Contract language

The contract language is English.

3. Ordering process and conclusion of the contract

The presentation of goods in the online shop does not constitute a binding offer but an invitation to place an order.

You add the desired goods to your cart and proceed from there to checkout, where you enter your contact, delivery and payment details. Before submitting your order, you will see a summary of the goods, the total price including VAT and the shipping costs. Until then, you can check and correct your entries in the cart and at checkout at any time.

By clicking the "Pay now" button, you submit a binding offer to purchase the goods in your cart.

Immediately afterwards, you will receive an automatic email confirming receipt of your order. This confirmation of receipt does not yet constitute acceptance of your offer.

The purchase contract is concluded as soon as we expressly accept your order or send you the shipping confirmation, whichever occurs first. If we do not accept your offer within three working days, you are no longer bound by it; in this case, we will refund any payment already made without undue delay.

If an ordered item is exceptionally unavailable, we will inform you without undue delay and will not accept your order to that extent. Any payments already made for this item will be refunded without undue delay.

We store the text of the contract. After the contract has been concluded, and at the latest upon delivery, you will receive a contract confirmation by email containing the order details and the withdrawal information including the model withdrawal form. If you use a customer account, you can also view your orders there. You can access, save and print these terms in the shop at any time.

4. Prices and shipping costs

All prices are stated in euros and include statutory VAT.

In addition, the following shipping costs per order apply for standard delivery: within Austria EUR 4.50, to all other delivery countries (see section 5) EUR 12.50. The total price and shipping costs are shown at checkout before you submit your order.

5. Delivery area, delivery and delivery times

We deliver to addresses in all member states of the European Union. Deliveries to countries outside the EU are not possible.

Goods are delivered by Österreichische Post AG to the delivery address you provide.

The delivery time is 5 to 7 working days within Austria and 7 to 10 working days to other EU countries from the date of your order, unless a different delivery time is stated for the item. Working days are Monday to Friday, excluding public holidays in Austria.

Partial deliveries are permitted where they are reasonable for you; they do not result in any additional shipping costs for you.

For consumers, the risk of loss of or damage to the goods only passes when the goods are delivered to you or to a third party designated by you who is not the carrier. For business customers, the risk passes when the goods are handed over to Österreichische Post AG.

Your statutory rights in the event of late delivery remain unaffected.

6. Payment

You can pay by Visa, Mastercard or Apple Pay. Apple Pay is only available on supported devices. Payments are processed via Shopify Payments; the payment service provider is Stripe Payments Europe Limited.

The invoice amount is due when you submit your order and is charged to your card at that time.

7. Retention of title

The goods delivered remain our property until paid for in full.

8. Customer account and guest checkout

You can order as a guest or create a customer account. Please keep your login details confidential and inform us if you suspect any misuse. You can request the deletion of your customer account at any time by email to office@town-town.store.

9. Withdrawal information

Consumers have the following statutory right of withdrawal (section 11 of the Austrian Distance and Off-Premises Contracts Act, FAGG):

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you have ordered multiple goods in one order and they are delivered separately, the withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (Lederleitner GmbH, Feldgasse 5, 3451 Michelhausen, Austria, phone: +43 1 5371111, email: office@town-town.store) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

You can also withdraw from the contract online using our withdrawal function: click the button "Withdraw from contract here" in the footer of every page of our shop, enter your name, your order number and your email address, and submit your withdrawal by clicking the button "Confirm withdrawal". We will then send you, without undue delay, an acknowledgement of receipt by email, stating the content of your withdrawal and the date and time of its receipt. The withdrawal function is available throughout the withdrawal period.

You can also exercise your right of withdrawal using the withdrawal form.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to the following address without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us: Lederleitner GmbH – Returns town-town.store, Tuchlauben 7a, 1010 Vienna, Austria. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

End of withdrawal information

10. Exceptions to the right of withdrawal

Pursuant to section 18 FAGG, there is no right of withdrawal, among other cases, for goods made to the customer's specifications or clearly personalised, and for sealed goods which are not suitable for return due to health protection or hygiene reasons if they were unsealed after delivery.

11. Statutory warranty

The statutory warranty rights apply, for consumers in particular under the Austrian Consumer Warranty Act (VGG). The warranty period is two years from delivery of the goods. If a defect becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery.

If a defect is remedied by repair, the warranty period is extended once by twelve months.

You can report defects to us at any time by email to office@town-town.store. Any manufacturer's guarantee applies in addition to, and does not limit, your statutory warranty rights.

For business customers, the statutory warranty rules apply, including the duty to inspect and give notice of defects under section 377 of the Austrian Commercial Code (UGB).

12. Liability

We are liable in accordance with the statutory provisions.

Towards business customers, our liability for damage caused by slight negligence is excluded. This does not apply to personal injury or to claims under the Austrian Product Liability Act.

13. Product presentation

We strive to present our products as accurately as possible. Depending on your screen and lighting, colours and surfaces may appear different. For handmade goods and natural materials, slight variations in colour, grain and shape are characteristic of the material. Your statutory warranty rights remain unaffected.

14. Data protection

We process your personal data in accordance with the applicable data protection laws. Details can be found in our privacy policy.

15. Complaints

16. Governing law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another country, you retain the protection afforded to you by the mandatory consumer protection provisions of that country.

For consumers, the statutory places of jurisdiction apply. For disputes with business customers, the court having subject-matter jurisdiction at the registered office of Lederleitner GmbH has jurisdiction.

17. Final provisions

Should any provision of these terms be invalid, the remaining provisions shall remain valid. The invalid provision shall be replaced by the statutory provision.

Each contract is governed by the version of these terms in force at the time the order was placed.
